API Terms of Service

1. Introduction and Scope
These API Terms of Service (“API Terms”) supplement the general Terms of Service available at https://waycite.com/terms. By accessing or using the WayCite Developer API (“API”), you agree to be bound by both these API Terms and the general Terms of Service. In the event of any conflict between these API Terms and the general Terms of Service, these API Terms shall prevail with respect to all API-related matters.
“Developer” means any individual or entity that registers for and uses the API. References to “you” and “your” in these API Terms refer to the Developer.
2. API Access and Authentication
- Access to the API requires registration for a developer account and the issuance of an API key.
- Each API key is confidential, non-transferable, and issued to a single developer account. You must not use an API key issued to another developer, nor permit another developer to use your API key.
- You are solely responsible for all activity that occurs under your API key, whether or not you have authorised such activity.
- You must not share, publish, or embed API keys in client-side code, public repositories, or any other location accessible to third parties.
- WayCite reserves the right to revoke, suspend, or regenerate API keys at any time, with or without notice, for breach of these API Terms, security concerns, or any other reason at our sole discretion.
3. Permitted Use
You may use the API solely for the following purposes:
- Integrating WayCite travel intelligence data into your applications, websites, or services.
- Displaying search results to your end users, provided that all attribution requirements set out in Section 4 are met in full.
- Building tools that help end users discover travel content sourced through the WayCite platform.
All uses not expressly permitted above require prior written consent from WayCite. Requests for additional use cases may be submitted to api@waycite.com.
4. Attribution Requirement (Mandatory)
THIS IS A MATERIAL TERM OF THESE API TERMS. FAILURE TO COMPLY CONSTITUTES A MATERIAL BREACH.
- Every search result displayed to an end user must include a hyperlinked attribution to the original source blogger. No exceptions.
- Attribution format: “Source: [Blog Name]” where [Blog Name] is a clickable hyperlink pointing to the original article URL as provided in the API response's attribution data.
- Attribution links must be clearly visible to the end user. They must not be hidden, obscured, rendered in a colour that blends with the background, placed behind additional clicks or expandable sections, or otherwise made difficult to perceive or interact with.
- You must not modify, truncate, rewrite, or remove any attribution data from API responses. The attribution data must be presented as provided by the API.
- Failure to comply with any aspect of this attribution requirement constitutes a material breach of these API Terms and may result in immediate suspension or termination of your API access without prior notice and without any right to cure.
5. Prohibited Use — Anti-Scraping
You must not:
- Systematically download, store, or cache API responses to build or contribute to a database, dataset, index, or any other structured collection of data.
- Use the API to crawl, scrape, or re-index the content accessible through it, whether directly or through intermediary systems.
- Redistribute raw API responses, or any substantial portion thereof, to third parties in any form, whether for commercial or non-commercial purposes.
- Use API data to create, develop, enhance, or operate a product or service that competes with WayCite or any aspect of the WayCite platform.
- Access the API through automated means that exceed your rate limit allocation, or use any technique designed to circumvent rate limits or usage quotas.
6. Prohibited Use — Anti-AI-Training
You must not:
- Use API responses, including but not limited to search results, content snippets, GEO scores, confidence scores, or attribution data, to train, fine-tune, distil, or evaluate any machine learning or artificial intelligence model.
- Feed API responses into any AI or ML pipeline as training data, validation data, test data, or for any form of model evaluation or benchmarking.
- Use API data to build, improve, or benchmark any generative AI system, including but not limited to large language models, retrieval-augmented generation systems, recommendation engines, or content generation tools.
These restrictions apply regardless of whether the model or system in question is commercial or non-commercial, open-source or proprietary, deployed or in research, and regardless of the quantity of API data used.
7. Rate Limits and Quotas
- API usage is subject to rate limits and quotas as specified in your subscription plan and the API documentation available at https://waycite.com/docs.
- You must implement proper handling of HTTP 429 (Too Many Requests) responses, including exponential backoff with jitter. Applications that do not implement appropriate backoff behaviour may be subject to additional rate restrictions.
- Sustained or deliberate attempts to exceed rate limits, whether through rapid polling, parallel requests exceeding your allocation, or any other technique, may result in temporary or permanent suspension of API access.
- WayCite reserves the right to adjust rate limits at any time. We will provide reasonable notice of changes that materially reduce your existing allocation.
8. Caching Restrictions
- You may cache API responses on the client side for a maximum period of twenty-four (24) hours from the time of the original API response.
- After the cache period has expired, you must re-validate data by making a fresh API request. You must not serve stale cached data to end users beyond the permitted cache period.
- You must not build, maintain, or contribute to a persistent derivative dataset from cached API responses. Caching is permitted solely for the purpose of reducing redundant API calls within the permitted cache period.
- All cached API data must be deleted immediately when your API access is terminated, suspended, or expires for any reason.
9. Data Accuracy and Disclaimer
- The API returns travel intelligence derived from AI-processed blog content. Confidence scores included in API responses are probabilistic assessments generated by artificial intelligence systems. They are not deterministic guarantees of accuracy or reliability.
- WayCite does not guarantee the accuracy, completeness, timeliness, reliability, or fitness for any particular purpose of any data returned by the API.
- API data should not be relied upon as professional travel advice, safety guidance, health advice, legal advice, or any other form of professional counsel. You are responsible for independently verifying any information obtained through the API before acting upon it.
- THE API AND ALL DATA RETURNED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
10. Availability and Support
- WayCite targets reasonable availability but does not guarantee any specific uptime percentage or service level agreement at this time. The API may be subject to downtime for maintenance, updates, or unforeseen technical issues.
- Scheduled maintenance will be announced in advance where practical, through the API documentation site or via email notification to registered developers.
- Current service status is available at https://waycite.com/status.
- API support is provided via email at api@waycite.com. Response times may vary and are not guaranteed.
11. Fees and Payment
- API access is offered under subscription plans as described on our pricing page.
- Fees are billed monthly in advance. Payment is due on the date specified in your invoice.
- Usage exceeding your plan's included quota may incur overage charges at the rates specified in your subscription plan. You may configure a monthly spending cap through your developer dashboard to limit overage charges. We will send email notifications when your usage reaches 80% and 100% of your plan quota. You are responsible for monitoring your usage and configuring appropriate spending limits.
- All fees are exclusive of applicable taxes, including VAT. You are responsible for paying all taxes and duties associated with your use of the API.
- We reserve the right to modify pricing at any time. Any pricing changes will take effect no earlier than thirty (30) days after written notice is provided to you. Continued use of the API after the effective date of a pricing change constitutes acceptance of the new pricing.
12. Suspension and Termination
- WayCite may suspend or terminate API access immediately and without prior notice for: (i) material breach of these API Terms, including but not limited to violations of the attribution requirements in Section 4, the anti-scraping provisions in Section 5, or the anti-AI-training provisions in Section 6; (ii) activity that poses a security threat to the API, its infrastructure, or other users; or (iii) legal or regulatory requirements.
- For non-critical breaches not covered by the preceding paragraph, WayCite will provide seven (7) calendar days' written notice and a reasonable opportunity to cure the breach before suspension or termination takes effect.
- Either party may terminate API access by providing thirty (30) calendar days' written notice to the other party. Notice to WayCite must be sent to legal@waycite.com.
- Upon termination or expiry of API access for any reason, you must: (i) immediately cease all use of the API; (ii) delete all cached API data in your possession or control; and (iii) upon request, certify in writing that you have complied with these obligations.
13. Force Majeure
WayCite shall not be liable for any failure or delay in providing the API where such failure or delay results from circumstances beyond WayCite's reasonable control, including but not limited to: third-party cloud infrastructure outages (including AWS), LLM provider service disruptions (including Anthropic and OpenAI), internet backbone failures, cyberattacks, natural disasters, government actions, or changes in applicable law. WayCite will use reasonable efforts to notify affected developers and restore service as soon as practicable.
14. Limitation of Liability
- To the maximum extent permitted by applicable law, neither party shall be liable to the other for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the API or these API Terms, including but not limited to loss of profits, loss of revenue, loss of data, loss of business opportunity, loss of goodwill, or cost of procurement of substitute services, regardless of the theory of liability (whether in contract, tort, strict liability, or otherwise) and even if the party has been advised of the possibility of such damages.
- Each party's total aggregate liability arising out of or in connection with the API or these API Terms shall not exceed the total API fees paid by you to WayCite in the twelve (12) months immediately preceding the event giving rise to the claim. If no fees have been paid by you to WayCite, the maximum aggregate liability shall be fifty pounds sterling (£50).
- Nothing in these API Terms excludes or limits liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be excluded or limited under the laws of England and Wales.
15. Developer Indemnification
You agree to indemnify, defend, and hold harmless WayCite, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your breach of these API Terms, including the attribution requirements, anti-scraping provisions, or anti-AI-training restrictions.
- Your use of the API or any data obtained through it.
- Any third-party claims arising from your application's use of API data, including claims of intellectual property infringement, defamation, or privacy violations.
- Your failure to comply with applicable laws in connection with your use of the API.
This indemnification obligation supplements the general indemnification provisions in Section 10 of the Terms of Service.
16. Notices
All formal legal notices under these API Terms must be in writing and shall be deemed duly given when: (a) sent by email to legal@waycite.com (for notices to WayCite) or to the email address associated with your developer account (for notices to you); or (b) sent by recorded delivery post to the registered office address of the receiving party. Notices sent by email are deemed received on the next business day after sending. Notices sent by post are deemed received two (2) business days after posting.
17. Dispute Resolution and Governing Law
The parties agree to the following tiered dispute resolution process before commencing court proceedings:
- Negotiation. The aggrieved party shall send written notice of the dispute to the other party. The parties shall have thirty (30) calendar days from receipt of such notice to resolve the dispute through good-faith negotiation.
- Mediation. If not resolved through negotiation, either party may propose mediation under the CEDR Model Mediation Procedure. Costs shall be shared equally. Mediation shall take place in London, England, unless otherwise agreed.
- Court proceedings. If not resolved within ninety (90) calendar days of the initial dispute notice, either party may commence court proceedings.
These API Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or in connection with these API Terms.
